UPDATE: Argument led to Monday shooting incident, Hayes remains in jail on multiple charges

A Cedartown man remains in jail after surrendering peacefully to police following a shooting incident and a three-hour standoff in a camper where he refused to come out until the SWAT team arrived.

Justin Steve Hayes, 40, of the same Kimwood Drive address where he was arrested late Monday afternoon following the more than three-hour he spent barricaded in a camper behind his parent’s home.

Monday’s incident began as an argument over trash bags between Hayes and his wife that escalated when, after living in the camper over the past several months, Hayes’ wife had enough and packed her bags to go.

Their blind dog jumped in the car to follow her, Hayes demanded that she leave the dog. She didn’t want to do so because the dog feared Hayes.

When she didn’t give up the dog, Hayes fired a shot at his wife through the car. His wife fled into his parents’ house to call 911, and Hayes ran into the camper where he refused to come out when police arrived and addressed him over a PA system.

Additional officers arrived and tried to talk him into coming out, but he continued to refuse. He at one point leaned out of the camper and showed his hands, but still wouldn’t come out.

“Justin is told he is making the situation worse on himself by not complying but seems to get more agitated the longer he is talked to,” a report on the incident said.

After more command staff and a negotiator was called out to the scene, the decision was made to call upon the services of the Floyd County SWAT team to come out to Kimwood Drive and end the standoff. Prior to the arrival of the SWAT team, Hayes was reported to have tossed out the handgun he fired but still refused to come out.

Warrants were obtained on multiple charges and to search the camper, and once the SWAT team arrived and family members talked to Hayes, he decided to give up to one of the officers who originally arrived on the scene.

Police took him into custody without further incident and he was taken to the Polk County Jail where he remains.

Hayes was charged and no bail had yet been set as of this posting. He was booked on felony charges of aggravated assault, criminal damage to property in the second degree, and possession of firearm or knife during commission of or attempt to commit certain felonies, and misdemeanor charges of reckless conduct, obstructing law enforcement officers, and discharge of firearms on or near public highway or street.
