A man pulled over by police late Monday blew more than three times the legal limit after an officer saw him nearly drive off the roadway, and drugs were found in his vehicle during a search per Polk County Police reports.
Caleb David Nichols, 20, of a Rome address, was stopped after he was spotted swerving by a Polk County Police officer around 10 p.m. on Monday, August 7 on Highway 101 heading north, and was pulled over at the intersection with Portland Road.
The report stated that Nichols had almost driven off the roadway prior to being stopped, and looked and acted as if he had been drinking. He told police he was having stomach issues and trying to get to a friend’s house just “up the road” but when questioned further, couldn’t explain to officers why he thought he was driving toward Rockmart, but had instead left from the area.
He then told police that he had been at the Garden Inn in Rockmart, and told police he had nothing to drink prior to getting behind the wheel.
Once Aragon PD arrived on scene as backup, officers searched the car before going through a field sobriety test, and found a torn open bag of marijuana in the floorboard, plus additional bags in the glove box and empty bags all around the car. When officers weighed it using Nichols own scale, it came out to more than ounce of the drug.
After he was unable to pass a field sobriety test, Nichols was asked to give a breath sample and an Alcosensor test came up with a blood alcohol content of .026, per the report. Police also took him to Atrium Health Floyd Polk Medical Center to have his blood drawn for testing. The drugs found along with paraphernalia were taken in for evidence.
Nichols was taken to the Polk County Jail and remained in custody without bond set on a felony charge of Possession of a Schedule I Controlled Substance, and misdemeanor charges of possession and use of drug-related objects, DUI, and failure to maintain lane.
