Rockmart man arrested on elder abuse, battery charge released on $6,000 bond

A Rockmart man was jailed and later released on a $6,000 bond after he struck his grandmother for refusing to give him money to go to McDonald’s, according to a Polk County Police report.

The report stated that Trevis Marquis Peek-Smith was taken into custody and held for five days on a felony charge for elder abuse-exploit/inflict pain to/deprive essential services to disabled person or elder person and misdemeanor simple battery after he was arrested on July 16 following an incident at his grandmother’s house. He also listed his grandmother’s address as his own, which is why it is not being shared at this time.

Peek-Smith, 20, is alleged to have gone to his grandmother’s house around 8:25 p.m., where he demanded money and when refused it “angered him and he became confrontational” and cussed and shoved her backward. When she tried to defend herself with a fly swatter and missed, Peek-Smith is alleged to have grabbed it and then hit her with an open palm across her face.

Just down the road, police caught up with Peek-Smith who was being confronted by family members and was already backed up against a car. Officers took him into custody without incident, where he was immediately transported to the Polk County Jail in “an attempt to diffuse the situation with the other family members.”

Peek-Smith did tell officers that he had asthma and required and inhaler. His grandmother was kind enough to bring it out for him before he was driven off to jail.

He was out today on the bond.
