
A Cedartown woman remained in the Polk County Jail after police were called out to a Dry Creek Road residence twice in one night over domestic incidents, according to Polk County Police reports.
Theresa Elizabeth Spain, 57, of a Cedartown address, remained in jail on a felony charge of terroristic threats and acts and misdemeanor charges that included three counts of obstructing law enforcement officers and two counts of simple battery against police/law enforcement dog/corrections or detention officer.
In their first trip out to Dry Creek Road in the late-night hours of Tuesday, August 24 that continued until Wednesday, August 25, police responded when the homeowner told officers he wanted Spain out of his house and his life due to her erratic behavior and the likelihood she was using drugs. The homeowner also told officers Spain had been without sleep for three days straight.
Per the report, they found Spain in the back of the residence with a folding lawn chair and unable to sit still. They asked her if she had taken any drugs, and told police that she had only taken pills. She also claimed the homeowner had drugs of his own.
When they asked the homeowner to search the house, police reported they found drugs in Spain’s room including a bottle of Gabapentin that didn’t belong to her. Police forced her to flush the drugs down the toilet and told the homeowner he would have to go through the eviction process to have her removed from the residence permanently.
Apparently, the police would end up taking care of the problem after they were forced to return with a second call to Dry Creek Road around 1:30 a.m. on August 25.
The second report was light on details, but officers stated they returned to the house due to a call for a domestic incident underway having “responded less than an hour ago” because of trouble being caused by Spain.
She was ultimately charged with the felony and misdemeanors above and was taken to the Polk County Jail, where she remained as of this posting with bond denied.
